CLARIFICATION TEXT ON THE PROCESSING OF PERSONAL DATA IN THE SUBSCRIPTION FORM

 

As Akın Yazılım Bilgisayar İthalat İhracat Sanayi ve Ticaret Ltd. Şti. (Akınsoft), we have prepared this clarification text to inform you about the processing, storage, and transfer of your personal data within the scope of our activities in accordance with the Law on the Protection of Personal Data No. 6698 (“PDPP”), the European Union General Data Protection Regulation (“GDPR”), and other relevant legislation and legal regulations.

(I) What Categories of Personal Data Do We Process and For What Purposes Do We Process Them?

The personal information of our visitors may be processed by Akın Yazılım in accordance with the principles set forth in Article 4.2 of the PDPP:

(i) Lawful and fair processing,

(ii) Accurate and up-to-date, when necessary,

(iii) Processed for specific, explicit, and legitimate purposes,

(iv) Relevant, limited, and proportionate to the purposes for which they are processed,

(v) Retained for the period required by applicable legislation or for the purposes for which they are processed.

In accordance with the principles, may be processed for the purposes set out below.

Identification information (e.g., name, surname) Contact information (e.g., address, phone number, e-mail address) Customer transaction information (e.g., order details, payment information, favorite products, shopping cart information, etc.)

(i) Conducting activities in compliance with legislation,

(ii) Managing information security processes,

(iii) Executing finance and accounting operations,

(iv) Managing company/product/service loyalty processes,

(v) Conducting communication activities,

(vi) Performing and auditing business operations,

(vii) Receiving and evaluating suggestions for business process improvement,

(viii) Ensuring business continuity,

(ix) Conducting logistics activities,

(x) Managing product/service sales processes,

(xi) Providing post-sale support services,

(xii) Conducting marketing analysis studies,

(xiii) Managing advertising/campaign/promotion processes,

(xiv) Managing customer relationship management processes,

(xv) Conducting activities for customer satisfaction,

(xvi) Tracking requests/complaints,

(xvii) Managing product/service marketing processes,

(xviii) Conducting storage and archiving activities

 

How Are Your Personal Data Collected?

The personal data you provided in the categories mentioned above are collected, partially or fully by automated means, through your use of our website, such as filling out the subscription form or membership information page, adding products to your cart or favorites, placing orders, returning purchased products, or submitting support requests.

 

(II) How Long Do We Retain Your Personal Data?

The personal data you provide in the categories mentioned above are retained for the period specified in the relevant legislation, if such a period exists; if no period is specified, they are retained for as long as our legitimate interest continues, taking into account the following criteria:

• Akınsoft applications

• Applied commercial practices

• Statutory limitation periods under relevant legislation

At the end of these periods, the retained personal data are deleted, destroyed, or anonymized.

 

(III) What is the Legal Basis for Collecting Your Personal Data?

Your personal data are processed by Akın Yazılım Bilgisayar İthalat İhracat Sanayi ve Ticaret Ltd. Şti. (Akınsoft) based on the legal grounds set forth in Article 5 of the PDPP, in order to achieve the purposes described above:

(i) Processing is necessary for the data controller to fulfill its legal obligations,

(ii) Processing is necessary for the establishment or performance of a contract, directly related to the parties of the contract,

(iii) Processing is necessary for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.

 

(IV) Do We Transfer Your Personal Data to Third Parties?

The personal data mentioned above may be transferred to authorized public institutions and organizations within the scope prescribed by law, for the purposes of conducting activities in compliance with legislation, monitoring and managing legal affairs, and providing information to authorized persons and institutions. They may also be transferred to cargo companies to deliver your orders and to our solution partners to the extent necessary to properly provide our services. Additionally, these personal data may be transferred to the law firm we work with and judicial authorities to be used as evidence in potential legal disputes.

(V) How Can You Exercise Your Rights Regarding Your Personal Data?

Right of Access: You have the right to request a copy of your personal data from our company. A nominal fee may be charged for this service.

Right to Rectification: If you believe any of your personal data are incorrect, you have the right to request correction from our company. If you believe any of your personal data are incomplete, you also have the right to request completion.

Right to Be Forgotten: Under certain circumstances, you have the right to request the deletion of your personal data from our company.

Right to Restrict Processing: In certain circumstances, you have the right to request that our company restrict the processing of your personal data.

Right to Object to Processing: In certain circumstances, you have the right to object to the processing of your personal data by our company.

Right to Data Portability: In certain circumstances, you have the right to request that your personal data obtained by us be transferred to another organization or directly to you.

Right to Withdraw Consent: You have the right to withdraw your explicit consent given to our company at any time, without affecting the lawfulness of the processing carried out based on your consent prior to its withdrawal.

Right to Lodge a Complaint with a Supervisory Authority: If you believe that your personal data has been processed in violation of applicable data protection regulations, you have the right to file a complaint with the competent regulatory authority, primarily in the EU, at your habitual residence or place of work, or in the Member State where you believe the data protection breach has occurred.

You can submit your requests regarding the rights mentioned above, as well as your requests under Article 11 of the PDPP concerning the rights of data subjects, to Akın Yazılım Bilgisayar İthalat İhracat Sanayi ve Ticaret Ltd. Şti. via the “Data Controller Application Form” prepared to facilitate the process for you, in accordance with the “Communiqué on the Procedures and Principles for Application to the Data Controller” available at “https://www.akinsoft.com.tr/”
